Terms of Service

Welcome to Portland Real Estate Media. By booking services with us, you agree to the terms outlined below. Please read them carefully.

1. Copyright & License

Copyright Notice
All photographs, videos, and other media (“Content”) produced by Portland Real Estate Media are the sole property of the Photographer and are protected under U.S. Copyright Law (Title 17, U.S. Code). Copyright is never transferred to the Client.

License Grant
Upon full payment, Client (and their brokerage) is granted a non-exclusive, non-transferable, limited license to use the Content solely for marketing and promotional purposes directly related to the sale or lease of the specific property for which it was commissioned.

Permitted Uses

  • MLS listings, brokerage websites, third-party platforms, and social media

  • Print marketing (flyers, brochures, postcards) for the commissioned property

  • Agent portfolios and self-promotion after the listing has sold, provided Content remains unaltered

Restrictions
Clients may not:

  • Sell, license, or transfer Content to third parties without written permission

  • Alter Content in a way that misrepresents the property (basic cropping/resizing is permitted)

  • Use Content for any property other than the one specified in the original agreement

Third-Party Usage
Builders, stagers, designers, or others must obtain their own license, even if involved in the project.

Term of License
The license remains valid while the property is actively marketed. Once the property is sold, leased, or taken off the market, the license expires.

Attribution
When possible, please credit “Photography by Portland Real Estate Media.”

2. Scheduling & Cancellations

  • Sessions should be scheduled at least 48 hours in advance.

  • Cancellations/reschedules must be made at least 24 hours prior. Same-day cancellations may be subject to a fee of up to 50% of the booking.

  • Photographer is not responsible for unfavorable weather. Rescheduling due to weather is at Photographer’s discretion.

3. Property Readiness

  • Client is responsible for ensuring the property is clean, staged, and photo-ready at the scheduled time.

  • Photographer is not responsible for cleaning, decluttering, or moving furniture.

4. Delivery Timeline

  • Photography & aerials: Next business day by 10:00 a.m.

  • Video & Matterport tours: 72 hours

  • Rush delivery: Available upon request for an additional fee

5. Reshoots & Additional Services

  • Reshoots due to property readiness, staging changes, or other client-controlled factors are subject to a $250 reshoot fee plus travel if applicable.

  • Additional editing requests outside the scope of the original agreement may be billed separately.

6. Payment Terms

  • Payment is due upon delivery of final media unless otherwise agreed in writing.

  • Portland Real Estate Media reserves the right to withhold delivery of Content until payment is received.

  • Late payments may incur a 10% monthly late fee.

7. Liability & Indemnification

  • Photographer is not liable for incidental or consequential damages, including but not limited to lost sales or marketing delays.

  • Client agrees to indemnify Photographer against any claims, damages, or expenses resulting from misuse of Content.

8. Agreement

By booking services with Portland Real Estate Media, Client acknowledges and accepts these Terms of Service.
